Layer order doing odd things

Here is my example:
The closest (or first) layer is at 0,0,0 (xyz). My character resides on this layer
The next layer in line is at 0,0,0 (x,y,z). My background resides on this layer.
I have a check in the box for SORT BY DEPTH in the main preferences menu.
For some reason the background appears before my character.
The only way to fix this is if I take my background layer to -2 or -3 on the z plane.
It will work for the most part, then.....
I move my character and again the background appears before my character in some areas of my project.
From this point, I move the background yet again on the z plane (to about -5)
It fixes this.
I know my layers are spaced apart. I can prove this using the 3d camera and actually seeing the space between layers.
I can work around it, however, I gets really difficult when you have a lot of layers.
Is this a bug?
