Well, I never got a reply to my post but I did learn the best solution.

With construction like what I've posted the best solution is to NOT select "Sort Layers by Depth". Then just play with their position in the layers palate.

I'm getting moving bands of color in gradients as they move in their animations . I don't see a way to resolve this so I assume it is a bug.
